Sexual assault or rape are charged under ARS §13-1406 and are defined as intentionally or knowingly engaging in sexual intercourse or oral sexual contact with any person without that person’s consent.  It is one of the most damaging crimes a person can be charged with and the potential penalties are so extensive that they are referred to as “life-enders”.

A sexual assault charges defense varies from case to case.  A Miranda rights violation may be used in a rape charges defense.  Before the police can interrogate the alleged perpetrator, the defendant has to be read their Miranda rights.  If the police fail to do so, do it improperly or do it in a manner where the defendant is unable to comprehend what has been read, then any statement they make and any evidence obtained as a result of those statements may be suppressed.
